Terms of Service
These terms are an agreement between you and Hyper Attention ("we", "us") for the use of the HyperCut app and the website usehypercut.com (together, "HyperCut"). By using HyperCut you agree to them. If you don't agree, please don't use HyperCut.
1. What HyperCut is
HyperCut is an iPhone app that transcribes video you record or import, proposes cuts (pauses, filler words, retakes), lets you review and change them, and exports the result. The cuts are suggestions produced by software; you are responsible for reviewing the result before you publish it.
2. Your account
You need an account to use HyperCut. Keep your sign-in details to yourself and tell us if you think someone else is using your account. You must be at least 13 years old (or the age of digital consent where you live) to create one.
3. Your content
Everything you record, import or export stays yours. You give us only the permissions needed to run the features you use, for example to process a transcript when you turn on the AI second look, and we don't claim any other rights to your content. You confirm you have the right to use the footage, music and other material you bring into HyperCut, and that you won't use HyperCut to make anything unlawful, defamatory or infringing.
4. Plans and payment
HyperCut requires a subscription. Plans are monthly or yearly, bought through Apple's App Store and governed by Apple's terms as well as these. Prices are shown in the app before you buy. There is no free trial unless the app says so at the time.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Manage or cancel them in your Apple Account settings; deleting the app does not cancel a subscription.
- Refunds are handled by Apple under its policies.
- Cut allowances reset each billing month and don't carry over. "Unlimited" plans are subject to fair use; we may contact you if usage suggests automated or resold use.
- We may change prices for new periods; we will tell you in advance and you can cancel before the change applies.
5. Acceptable use
Don't try to reverse engineer HyperCut, interfere with the service, resell access, or use it to process content you have no right to process. We may suspend accounts that break these terms or the law.
6. Third-party services
HyperCut uses Apple, Google, Supabase, RevenueCat and (for cloud processing) Deepgram to operate, as described in our Privacy Policy. Their availability is outside our control.
7. Availability and changes
HyperCut is in early access. Features may change, and we may add, remove or alter them. We aim to keep the service available but don't promise uninterrupted operation. If we discontinue a paid feature you depend on, you can cancel and will not be charged for further periods.
8. Disclaimer and limitation of liability
HyperCut is provided "as is". To the extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement, and we are not liable for indirect, incidental or consequential damages, or for loss of content you have not backed up. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Nothing here limits rights you have as a consumer that cannot be limited by contract.
9. Ending the agreement
You can stop using HyperCut and delete your account at any time in Settings. We can end or suspend access if you break these terms. Sections 3, 8 and 10 survive termination.
10. General
If part of these terms turns out to be unenforceable, the rest still applies. These terms, together with the Privacy Policy, are the whole agreement between you and us about HyperCut. We may update them; material changes will be announced in the app, and continuing to use HyperCut after that means you accept the new terms.
